Terms of service

1. Seller identity and scope

The online store is operated by DYNAMIC SIMRACING DI JUAN MANUEL GOMEZ GIRALDO, an Italian individual enterprise with registered office at Via Dante Alighieri 46, 01027 Montefiascone (VT), Italy; VAT number IT02518740564; fiscal code GMZJMN97S10Z604Z; REA VT-215515; registered with the Registro delle Imprese di Rieti-Viterbo; customer email dynamicsimracingsales@gmail.com; PEC for formal legal communications juanmanuel.gomezgiraldo@pec.fiscozen.it (the "Seller", "we", "us" or "our").

These Terms apply to use of the online store and purchases from it. Consumers retain all mandatory protections provided by the law of their habitual residence where those protections cannot be waived. If you purchase primarily for professional or commercial purposes, consumer-specific provisions may not apply.

2. Products and information

We sell sim-racing hardware, components, DIY materials, digital content and related products. Product descriptions, compatibility statements, dimensions, specifications, included items and production estimates shown on the relevant product page form part of the pre-contract information. Minor visual differences caused by screens, materials or manufacturing tolerances do not by themselves constitute non-conformity where the product otherwise matches the agreed description and mandatory standards.

Customers must review compatibility and installation requirements before ordering. Assistance or compatibility guidance is based on information supplied by the customer and does not replace the product specifications.

3. Orders and contract formation

Submitting an order is an offer to purchase. The customer must check the order, delivery details and total price before confirming the obligation to pay. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. The contract is accepted when we issue an order confirmation or begin fulfilment, subject to mandatory law.

We may reject or cancel an order for legitimate reasons, including unavailability, obvious pricing error, suspected fraud, payment failure, legal restrictions or inability to deliver. If payment has been captured for a cancelled order, it will be refunded without undue delay.

4. Prices, VAT and payment

Prices and applicable taxes are displayed before purchase. Shipping charges are shown at checkout. For destinations outside the EU, import VAT, customs duties, tariffs, brokerage and clearance charges are the recipient's responsibility unless checkout expressly states otherwise. Payment must be made through the methods offered at checkout. We do not add a payment-method surcharge beyond what is permitted by law.

5. Made-to-order and personalised goods

Made-to-order means production or assembly begins after purchase. A standard catalogue item does not become legally personalised merely because it is assembled after ordering. Where a product is made to the customer's specifications or clearly personalised, this will be stated before purchase and the statutory withdrawal exception may apply. We may voluntarily allow cancellation before production begins. Defect and conformity rights remain unaffected.

6. Digital content

Digital files, software and licences are supplied under the licence terms stated with the product. Unless expressly permitted, they are licensed for the purchaser's personal use and may not be copied, redistributed, sold, published or commercially exploited. Immediate supply and loss of the withdrawal right require the consumer's separate express consent and acknowledgement where required by law.

7. Delivery, customs and failed delivery

Delivery is governed by the Shipping Policy. The customer must provide accurate delivery and customs information. For non-EU destinations, the recipient is responsible for import charges. Actual, documented costs caused by an incorrect address, uncollected or refused delivery, or unpaid customs charges may be recovered or deducted from a refundable balance to the extent permitted by mandatory law.

8. Withdrawal, returns and refunds

Withdrawal, return and refund rights are governed by the Return and Refund Policy and applicable mandatory law. No fixed restocking fee applies merely because a package was opened. A deduction may apply for objectively demonstrated diminished value caused by handling beyond what was necessary to inspect the product.

9. Legal guarantee and commercial warranties

Consumers receive the applicable statutory legal guarantee of conformity, generally for at least two years from delivery within the EU. Where a product is non-conforming, remedies are provided without charge in the order and circumstances required by law. Any stated commercial warranty is additional and does not reduce statutory rights.

10. Intellectual property

The store, product designs, drawings, photographs, graphics, manuals, software, digital files, trademarks and other content are protected by intellectual-property laws. No right is granted except the limited use necessary to access the store or use a purchased product in accordance with its applicable licence and instructions.

11. Prohibited use

You must not misuse the store, attempt unauthorised access, introduce malicious code, scrape or copy protected content unlawfully, infringe third-party rights, submit false information, evade technical protections or use products or content for unlawful purposes.

12. Liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory product-safety or consumer law, or any liability that cannot legally be excluded. Subject to those limits, we are not responsible for losses not reasonably foreseeable when the contract was made, or business losses suffered by a consumer acting outside a business purpose.

13. Privacy

Personal data is processed in accordance with the Privacy Policy and applicable data-protection law. Non-essential cookies and promotional communications are subject to the consent choices required by law.

14 Governing law and disputes

These Terms are governed by Italian law, without depriving consumers of mandatory protections available under the law of their habitual residence. A consumer may bring proceedings before the courts competent under mandatory consumer-jurisdiction rules, including, where applicable, the courts of the consumer's domicile. The parties are encouraged to contact each other first to seek an amicable resolution and may use any competent consumer alternative-dispute-resolution body.

15. Changes and severability

We may update these Terms for future use of the store. The version applicable to an order is the version made available when the order was placed unless a mandatory legal change requires otherwise. If a clause is invalid or unenforceable, the remaining clauses continue to apply to the extent permitted by law.
